These Terms and Conditions of Sale (hereinafter the “Terms”) govern the sale of products by DROPINFINITY to customers through its online store.

Placing an order implies acceptance of these Terms in accordance with applicable regulations.

2. Purpose and Scope

These Terms define the rights and obligations of DROPINFINITY and the customer in connection with the distance sale of products offered through the online store.

They apply to orders placed by consumers, subject to any mandatory provisions of applicable law.

3. Products

The essential characteristics of the products are presented on the relevant product pages of the online store.

Customers are invited to review the characteristics, dimensions, features, and any customization options before placing an order.

DROPINFINITY makes every reasonable effort to present products as accurately as possible. Slight differences in color or appearance may result from screen display settings.

4. NFC Products and QR Codes

Certain products sold by DROPINFINITY may incorporate NFC technology, a QR code, a URL, or other features allowing access to digital content or services.

Their operation may depend on the device used, operating system, device configuration, internet connection, and third-party services or platforms to which they redirect.

DROPINFINITY has no control over modifications or interruptions made by third-party platforms.

5. Product Customization

Certain products may be customized at the customer's request, including with a logo, text, artwork, URL, QR code, NFC programming, or any other customization option offered on the website.

The customer is responsible for the accuracy of the information and files provided for customization.

The customer also represents that they have all necessary rights to use any logos, images, trademarks, text, or other content submitted to DROPINFINITY.

6. Availability

Products are offered subject to stock availability and, for customized products, applicable production capacity.

If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible and the available solutions will be offered, including a refund where applicable.

7. Prices

The applicable prices are those displayed on the online store when the order is confirmed.

Prices displayed to consumers include all applicable taxes where required by law.

Shipping charges and any other applicable additional costs are communicated to the customer before final confirmation of the order.

DROPINFINITY may change its prices at any time. Any such change will not affect orders already confirmed at the previously displayed price.

8. Orders

To place an order, the customer selects the desired product or products and, where applicable, their customization options.

Before confirming the order, the customer can review the products, quantities, options, prices, delivery information, and other information provided, and correct any errors.

Final confirmation of the order creates an obligation to pay.

An order confirmation is sent to the email address provided by the customer.

9. Payment

Payment is made using the payment methods available during checkout.

The customer represents that they are authorized to use the selected payment method.

DROPINFINITY may suspend the processing of an order where payment is refused or cannot be confirmed.

10. Verification and Fraud Prevention

DROPINFINITY may carry out reasonable checks necessary to prevent fraudulent payments.

An order may be suspended or cancelled where there is a legitimate reason to do so, including payment refusal, clearly inconsistent information, or reasonable suspicion of fraud.

11. Order Preparation

Once payment has been confirmed, the order enters preparation.

Customized products may require additional manufacturing or preparation time before shipment.

12. Delivery

Products are delivered to the address provided by the customer when placing the order.

Applicable delivery times or estimates are communicated to the customer during the ordering process where available.

Delivery times may vary depending on the product, customization, destination, and shipping method.

Where applicable law provides for a maximum delivery period in the absence of an agreed delivery date or period, the relevant statutory provisions remain applicable.

13. Incorrect Delivery Address

The customer must ensure that the delivery address is accurate and complete before confirming the order.

If an error is identified after the order has been placed, the customer should contact DROPINFINITY as soon as possible at contact@feedtrack.fr.

DROPINFINITY will attempt to update the information where technically possible but cannot guarantee that changes can be made once preparation or shipment has begun.

14. Delivery Tracking

Where tracking is available, a tracking number or link may be provided to the customer after shipment.

There may be a delay between the creation of the tracking number and its first update by the carrier.

15. Delivery Delays or Issues

In the event of a delay, loss, or other delivery issue, the customer may contact DROPINFINITY at: contact@feedtrack.fr.

The consumer's rights under applicable law remain fully applicable.

16. Receipt and Damaged Products

Customers are invited to inspect their order upon receipt.

If a product is damaged, incorrect, incomplete, or presents any other issue, the customer may contact: contact@feedtrack.fr.

Photographs of the product and its packaging may be requested to facilitate assessment of the issue.

17. Right of Withdrawal

Where the customer acts as a consumer and the right of withdrawal applies, the customer has 14 days from receipt of the goods to exercise their right of withdrawal without having to provide a reason.

To exercise this right, the customer must inform DROPINFINITY of their decision by means of a clear and unambiguous statement or by using the withdrawal form provided.

18. Customized Products and Right of Withdrawal

In accordance with the exceptions provided under the French Consumer Code, the right of withdrawal may not apply to goods made to the consumer's specifications or clearly personalized.

This exception may include products specifically manufactured or customized for the customer using their logo, text, artwork, or other specific characteristics where the legal requirements for the exception are met.

This exception to the right of withdrawal does not affect the customer's statutory rights where a product is defective or non-conforming.

19. Returns

Where a return is made following the exercise of the right of withdrawal, the customer must return the product within the period prescribed by applicable law.

Direct return shipping costs are borne by the customer where permitted by law and where this information has been communicated to the customer.

20. Refunds

Where a refund is due following the valid exercise of the right of withdrawal, it will be issued in accordance with the deadlines and procedures required by applicable law.

For sales of goods and where permitted by law, DROPINFINITY may withhold the refund until the product has been recovered or until proof of return shipment has been provided.

Refunds will be issued using the same payment method used for the original transaction unless the customer expressly agrees to another method that does not result in additional fees.

21. Legal Guarantee of Conformity

Consumers benefit from the statutory legal guarantee of conformity under the conditions provided by the French Consumer Code.

For goods covered by this legal regime, consumers may benefit from the remedies provided by law where a lack of conformity appears within the applicable statutory period following delivery.

The legal guarantee of conformity applies independently of any commercial warranty.

22. Warranty Against Hidden Defects

Where the applicable conditions are met, customers also benefit from the statutory warranty against hidden defects provided for under Articles 1641 et seq. of the French Civil Code.

Nothing in these Terms limits any mandatory statutory rights granted to consumers.

23. Use of Products

Products must be used in accordance with their intended purpose and any instructions provided.

DROPINFINITY shall not be liable for consequences resulting from clearly improper, abusive, or unauthorized use, subject to any liability that cannot legally be excluded.

24. Third-Party Platforms

Certain products may redirect users to services operated by third-party companies.

These platforms may independently change their services, features, interfaces, rules, or terms of use.

The customer is responsible for their use of such platforms and for complying with their applicable terms of use.

25. Customer Intellectual Property

When the customer provides a logo, trademark, photograph, design, text, or other content for product customization, the customer represents that they have all necessary rights to use and reproduce such content.

DROPINFINITY may refuse customization that is clearly unlawful or clearly infringes the rights of a third party.

26. Liability

DROPINFINITY is responsible for performing its obligations in accordance with applicable law.

Nothing in these Terms is intended to exclude or limit any mandatory consumer right that cannot legally be excluded or limited.

27. Force Majeure

DROPINFINITY shall not be liable for failure to perform its obligations resulting from an event qualifying as force majeure under French law.

28. Personal Data

Personal data collected in connection with orders is processed in accordance with applicable regulations and the Privacy Policy available on the website.

29. Complaints

For any complaint concerning an order, the customer may contact DROPINFINITY at:

Customers are encouraged to include their order number and any information necessary to process the request.

30. Consumer Mediation

In the event of a dispute, consumers are invited to first submit a complaint to DROPINFINITY at: contact@feedtrack.fr.

Following a prior written complaint to DROPINFINITY, and where the dispute has not been resolved directly, consumers may use the consumer mediator to which DROPINFINITY belongs free of charge, in accordance with the French Consumer Code.

31. Governing Law

These Terms and Conditions of Sale are governed by French law.

Where the customer is a consumer residing in another country, this provision does not deprive them of any mandatory protections available under applicable law.

32. Dispute Resolution

The parties are encouraged to seek an amicable solution before initiating legal proceedings.

If no amicable resolution is reached, the dispute may be submitted to the competent courts in accordance with applicable legal rules.

33. Changes to These Terms

DROPINFINITY may amend these Terms and Conditions of Sale to reflect, in particular, changes to its business, products, or applicable regulations.

The Terms applicable to an order are those in effect at the time the order is placed.
